The Role of USACOE

The USACOE is responsible for ensuring that the proposed Project activities are consistent with Section 404 of the Clean Water Act and Section 10 of the Rivers & Harbors Act.  Permit applications must be filed for the construction and operation of the marine berthing facilities as well as for dredging activities associated with the marine activities.
As the marine berthing facilities will be multi-purpose, designed to increase the overall operational flexibility of Port Operations, the Oregon International Port of Coos Bay will own and operate the marine facilities associated with the Jordan Cove Project, and will be applicant for the 404 and Section 10 permits.
   
About the Process

As a cooperating federal agency, the USACOE will participate in the public scoping meetings and will provide comments to the FERC on the Environmental Impact Study (EIS).  As part of the concurrent application process for the Port permit applications, the USACOE will also solicit public comments, specifically related to the USACOE regulated activities.
